Expert Analysis"},"content":{"rendered":"<p><i>Exactly a year had passed since Russia started occupation of Crimea and annexed it. A lot of discussion still exists regarding what this event means in terms of the international law. We would like to quote opinion of Dr. Alexander Zadorozhny, \u0421hair of the Department of the International Law at the Institute of International Relations of the National Taras Shevchenko University of Kyiv. Dr. Zadorozhny expressed his <\/i><a href=\"https:\/\/www.facebook.com\/alexander.zadorozhny\/posts\/885116638231905\"><i>personal opinion in a Facebook profile<\/i><\/a><i>.\u00a0<\/i><\/p>\n<p>There is a number of ways for states to get a new territory <b>legitimately<\/b>:<\/p>\n<p>1) changes, related to the natural processes (accretion);<\/p>\n<p>2) transfer of a territory based on a mutual agreement of the states concerned (cession);<\/p>\n<p>3) partition of the state, based on the mutual agreement of its subjects. Here we are dealing not with the cession of the territory, but with the dissolution of the predecessor state and appearance of successor states, who become subjects of the international law;<\/p>\n<p>4) change of the ownership of the territory, based on the decision of the duly authorized international judicial institution (adjudication);<\/p>\n<p>5) obtaining sovereignty over the territory based on the antiquity of tenure;<\/p>\n<p>6) implementation of the principle of self-determination based on the relevant provisions of the international treaties and doctrinal principles of the international law (secession or an act of withdrawal from the state, undertaken by its territorial entity);<\/p>\n<p>7) unification of the two or more states into a single entity or inclusion of one state into another state as its new territorial entity.<\/p>\n<p>All documents, related to the official position of the current Russian government, namely: <i>An Agreement on Annexation of Crimea by the Russian Federation<\/i> of 18.03.2014, <i>Statement of the Ministry of Foreign Affairs of the Russian Federation Regarding accusations of violation of Budapest Memorandum<\/i> of 01.04.2014, <i>Legal Position of the Russian Federation on Crimea and Ukraine<\/i>, as well as statements made by the senior Russian government officials and the research, published by the Russian legal scholars, emphasize \u2018implementation of the right to self-determination by the Crimean nation\u2019. The outcome of such \u2018self-determination\u2019 was that the \u2018Crimean nation\u2019 allegedly \u2018ceded\u2019 Crimea from Ukraine, \u2018created\u2019 independent state and \u2018joined\u2019 the Russian Federation.<\/p>\n<p>Yet true facts ruin these theories. International law has strict rules for establishing a legitimacy of self-determination, secession and adhering to the international principle of territorial integrity.<\/p>\n<hr \/>\n<p><b>International law does not recognize a \u2018right to self-determination\u2019, that was exercised under duress and strict guidance by a foreign army and foreign special forces.<\/b><\/p>\n<hr \/>\n<p>An attempt by the Russian government to depict the political processes that happened in Crimea during last Spring as something consisting of the two stages (first \u2014 <i>secession and creation of the \u2018Crimean Republic\u2019<\/i>, second \u2014 <i>acceptance of the new state into Russian Federation and actual accession<\/i>) is not supported neither by facts, nor by the international legal doctrine and treaties. \u2018Crimean Republic\u2019 could not elect independent public administration and this violates one of the basic requirements for it to be recognized as the independent state.<\/p>\n<p>Lack of intention to exercise statehood is evidently demonstrated by the <i>Declaration of the Independence of Crimea<\/i> and almost simultaneous holding of a \u2018referendum\u2019 of March 16, 2014 which was followed by the hasty announcement of the \u2018referendum\u2019 results on March 17, 2014 and the decision of the State Duma to accept an \u2018offer\u2019 of the \u2018Crimean Republic\u2019 to join the Russian Federation. Then \u2018Crimean Republic\u2019 \u2018signed\u2019 the <i>Treaty of Accession of Crimea to the Russian Federation<\/i> on March 18, 2014 thereby completing a chain of subordination of the \u2018Crimean government\u2019 to the Russian army command. The \u2018Crimean Republic\u2019 could not meet any of the prerequisites of the international law to be recognized an independent state, even if we consider the broadest set of such prerequisites.<\/p>\n<p>\u2018Crimean secession\u2019 lacks any legal basis that is based on the international law. We should note that it also lacks any exceptional circumstances justifying such a secession, e.g.: gross and massive human rights violations (by Ukrainian government of that time); state violence against a certain ethnic group; existence of a nation, i.e. subject of the right to self-determination; impossibility of the \u2018internal self-determination\u2019; <i>de facto<\/i> recognition of a state by the international community.<\/p>\n<p>Analysis of the Crimean events of 2014 from the standpoint of the international law demonstrates, that the Russian Federation did not get its sovereignty over the peninsula in accordance with the internationally recognized methods of acquisition of a new territory.<\/p>\n<p>What indeed happened was a military takeover and annexation. While committing this illegal takeover Russia violated most of its obligations to respect territorial sovereignty of other states, which it had undertaken as a member of the United Nations, bound by the <i>UN Charter, Helsinki Final Act,<\/i> article 5 of the <i>Belavezha Accords<\/i> of 1991 (creating CIS), item\u00a02\u00a0of\u00a0the\u00a0<i>Budapest Memorandum on Security Assurances<\/i> of 1994 (regulating Ukraine\u2019s accession to the Treaty on the Non-Proliferation of Nuclear Weapons), article 2 of the Treaty on Friendship, Cooperation and Partnership Between the Russian Federation and Ukraine of 1997, the Treaty on the Russian-Ukrainian State Border of 2003.<\/p>\n<p><a href=\"https:\/\/informnapalm.org\/ua\/zadorozhny-pro-krym\"><i>Original article<\/i><\/a><i>, based on a <\/i><a href=\"https:\/\/www.facebook.com\/alexander.zadorozhny\/posts\/885116638231905\"><i>Facebook post<\/i><\/a><i> by Dr. Alexander Zadorozhny, translated by Gennadiy Kornev<\/i><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Exactly a year had passed since Russia started occupation of Crimea and annexed it. Here we are dealing not with the cession of the territory, but with the dissolution of the predecessor state and appearance of successor states, who become subjects of the international law;\r\n\r\n4) change of the ownership of the territory, based on the decision of the duly authorized international judicial institution (adjudication);\r\n\r\n5) obtaining sovereignty over the territory based on the antiquity of tenure;\r\n\r\n6) implementation of the principle of self-determination based on the relevant provisions of the international treaties and doctrinal principles of the international law (secession or an act of withdrawal from the state, undertaken by its territorial entity);\r\n\r\n7) unification of the two or more states into a single entity or inclusion of one state into another state as its new territorial entity.\r\n\r\nAll documents, related to the official position of the current Russian government, namely: <i>An Agreement on Annexation of Crimea by the Russian Federation<\/i> of 18.03.2014, <i>Statement of the Ministry of Foreign Affairs of the Russian Federation Regarding accusations of violation of Budapest Memorandum<\/i> of 01.04.2014, <i>Legal Position of the Russian Federation on Crimea and Ukraine<\/i>, as well as statements made by the senior Russian government officials and the research, published by the Russian legal scholars, emphasize \u2018implementation of the right to self-determination by the Crimean nation\u2019. The outcome of such \u2018self-determination\u2019 was that the \u2018Crimean nation\u2019 allegedly \u2018ceded\u2019 Crimea from Ukraine, \u2018created\u2019 independent state and \u2018joined\u2019 the Russian Federation.\r\n\r\nYet true facts ruin these theories. International law has strict rules for establishing a legitimacy of self-determination, secession and adhering to the international principle of territorial integrity.\r\n\r\n<hr \/>\r\n\r\n<b>International law does not recognize a \u2018right to self-determination\u2019, that was exercised under duress and strict guidance by a foreign army and foreign special forces.<\/b>\r\n\r\n<hr \/>\r\n\r\nAn attempt by the Russian government to depict the political processes that happened in Crimea during last Spring as something consisting of the two stages (first \u2014 <i>secession and creation of the \u2018Crimean Republic\u2019<\/i>, second \u2014 <i>acceptance of the new state into Russian Federation and actual accession<\/i>) is not supported neither by facts, nor by the international legal doctrine and treaties. \u2018Crimean Republic\u2019 could not elect independent public administration and this violates one of the basic requirements for it to be recognized as the independent state.\r\n\r\nLack of intention to exercise statehood is evidently demonstrated by the <i>Declaration of the Independence of Crimea<\/i> and almost simultaneous holding of a \u2018referendum\u2019 of March 16, 2014 which was followed by the hasty announcement of the \u2018referendum\u2019 results on March 17, 2014 and the decision of the State Duma to accept an \u2018offer\u2019 of the \u2018Crimean Republic\u2019 to join the Russian Federation. Then \u2018Crimean Republic\u2019 \u2018signed\u2019 the <i>Treaty of Accession of Crimea to the Russian Federation<\/i> on March 18, 2014 thereby completing a chain of subordination of the \u2018Crimean government\u2019 to the Russian army command. The \u2018Crimean Republic\u2019 could not meet any of the prerequisites of the international law to be recognized an independent state, even if we consider the broadest set of such prerequisites.\r\n\r\n\u2018Crimean secession\u2019 lacks any legal basis that is based on the international law. We should note that it also lacks any exceptional circumstances justifying such a secession, e.g.: gross and massive human rights violations (by Ukrainian government of that time); state violence against a certain ethnic group; existence of a nation, i.e. subject of the right to self-determination; impossibility of the \u2018internal self-determination\u2019; <i>de facto<\/i> recognition of a state by the international community.\r\n\r\nAnalysis of the Crimean events of 2014 from the standpoint of the international law demonstrates, that the Russian Federation did not get its sovereignty over the peninsula in accordance with the internationally recognized methods of acquisition of a new territory.\r\n\r\nWhat indeed happened was a military takeover and annexation.
